1. Who you are dealing with

Thin Air is developed and published by [LEGAL NAME — set legal.sellerName in site.config.json], a sole proprietor based in Israel ("I", "me"). These terms are a contract between you and me for the use of the Thin Air app, the Thin Air screen saver, Thin Air Pro licenses and this website. Contact: alvolio10@gmail.com.

Pro licenses are sold through Lemon Squeezy, LLC, acting as merchant of record and reseller. Your purchase itself is also subject to Lemon Squeezy's terms and buyer terms. If these terms and Lemon Squeezy's conflict about the payment transaction, Lemon Squeezy's terms govern the transaction; these terms govern the software.

2. The free app

You may download, install and use Thin Air free of charge on any Mac you own or control, for personal and professional use. The free app includes the Playground, Thin Air Everywhere, the screen saver, seasonal visitors, shapes, themes and free updates.

3. Thin Air Pro license

• What you get. A perpetual, non-exclusive, non-transferable license to use the advanced Studio features of Thin Air, unlocked by a license key, on up to three (3) Macs that you own or control at the same time. You can deactivate a Mac from inside the app to free a seat.
• One-time payment. The price shown at checkout is a one-time fee. There is no subscription. Updates to the version line you bought are included; if a future major version is ever sold separately, it will be announced clearly and your existing version keeps working.
• License checks. The app verifies your key with the store at activation and periodically afterwards, and keeps working for 14 days without a connection on the last successful check. A refunded or chargeback'd key is disabled and the advanced Studio features lock again.
• Keep your key private. Do not share, publish, sell or lend your license key. I may disable keys that are shared publicly or activated beyond the limit, after trying to contact you.

4. Things you may not do

• Remove, circumvent or tamper with the license check, code signature or notarization.
• Redistribute, sell, rent or sublicense the app or any part of it, or bundle it with other products, without written permission.
• Claim the app, its artwork, its clips or its name as your own. (Recording the app for a video or a post about it is welcome; a mention is appreciated but not required.)
• Use the app in a way that breaks the law or someone else's rights.

5. Your scenes are yours

Anything you create with Thin Air (scenes, screenshots, recordings) belongs to you. I claim no rights in it and never receive it.

6. Updates and availability

The app can check for and offer updates (see the privacy policy). I may change, add or retire features over time; if a retirement would affect something you paid for, I will say so in advance and keep the last version that had it available for download. I may stop distributing the app altogether, in which case installed copies and activated licenses keep working.

7. Privacy

How the app and this site handle data is described in the privacy policy, which is part of these terms.

8. Refunds

Pro purchases can be refunded within 14 days of purchase, no questions asked, as described in the refund policy. Refunds are issued by Lemon Squeezy to the original payment method.

9. No warranty

Thin Air is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted operation or freedom from errors, to the fullest extent permitted by law. It is a real-time graphics application: performance depends on your Mac. Nothing in these terms limits rights that consumer law in your country gives you and that cannot be waived.

10. Limitation of liability

To the fullest extent permitted by law, my total liability to you for any claim arising out of the app or these terms is limited to the amount you paid for Thin Air Pro in the twelve months before the claim (or, for the free app, zero). I am not liable for indirect, incidental or consequential damages, lost data or lost profits. Nothing here excludes liability for fraud, gross negligence or anything that cannot be excluded under applicable law.

11. Termination

You can stop using the app at any time by deleting it. I may terminate your license if you materially breach these terms and do not fix the breach after being told about it; in that case you must stop using Pro features, and no refund is owed for a breach of section 3 or 4.

12. Governing law

These terms are governed by the laws of the State of Israel, and disputes are subject to the courts of Israel, except that if you are a consumer in a country whose law grants you the protection of your local courts and consumer rules, you keep that protection.

13. Changes to these terms

I may update these terms; the current version is always at this address with its date at the top. Material changes to the Pro license will be announced in the app's release notes before they take effect. Continuing to use the app after a change means you accept the new terms.

14. Trademarks and credits

macOS and Mac are trademarks of Apple Inc. Thin Air is not affiliated with or endorsed by Apple. Lemon Squeezy is a trademark of its owner.

The reflections in the app and in the bubbles on this website use the "Artist Workshop" HDRI by Oliksiy Yakovlyev from Poly Haven (CC0). This site's typefaces are Karantina by Rony Koch and Geist by Vercel, both under the SIL Open Font License 1.1. The website uses three.js (MIT) for the bubbles on the home page.
